Liquor Liability Insurance in Alaska

A person who provides alcohol is generally not civilly liable for injuries from another’s intoxication unless that person is a licensee (or its agent/employee) and either served a drunken person in violation of AS 04.16.030, or furnished alcohol to a person under 21. Liability is strict for those violations, and voluntary consumption is not a defense.

Alaska imposes dram-shop liability by statute. Under AS 04.21.020, a licensee (or its agent/employee) is civilly liable for injuries caused by a patron’s intoxication only if it served a drunken person in violation of AS 04.16.030, or furnished alcohol to someone under 21. Voluntary consumption by the drinker is not a defense.

Is liquor liability insurance required in Alaska?

Alaska does not require liquor-liability insurance to hold an alcohol license. Coverage is routinely required by landlords, lenders, and franchisors, and is strongly advisable given statutory strict liability. A good-faith ID defense exists for the under-21 prong.

What liquor liability costs in Alaska

  • Restaurant: ~$45/mo (~$538/yr) at $1M/$2M limits (Insureon)
  • Bar / tavern: ~$115/mo (~$1,379/yr) at $2M limits (Insureon)
  • Nightclub: $1,500–$4,000+/yr (estimate)

What owners in Alaska miss

  • Liability is limited to licensees and their agents/employees — not social hosts serving adults.
  • Strict liability attaches to the qualifying violations (serving a drunken person or an underage person); voluntary consumption is expressly not a defense.
  • A good-faith ID defense exists for the under-21 prong if a compliant ID or signed statement was obtained.
  • AMCO and its ABC Board are the sole state licensing/enforcement authority (Alaska licenses at the state level).
